Refund policy

This policy applies to products purchased from The Moment Collective Pty Ltd trading as Bean & Barrel (ABN 67 696 292 369).

1. YOUR AUSTRALIAN CONSUMER LAW RIGHTS

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

Depending on the circumstances, you may be entitled to a refund, replacement, repair, compensation or another remedy where goods fail to satisfy an applicable consumer guarantee.

2. DAMAGED, FAULTY OR INCORRECT PRODUCTS

Please contact us as soon as reasonably possible if:

  • your product arrives damaged;

  • you receive an incorrect product;

  • an item is missing from your order;

  • the product is faulty or unsafe;

  • a food or beverage product is not of acceptable quality; or

  • the product otherwise fails to satisfy an applicable consumer guarantee.

Contact coffee@beanandbarrel.com.au and provide your order number and details of the issue.

We may reasonably request photographs or other information to assist us in assessing the problem.

We will provide the remedy required by the Australian Consumer Law based on the circumstances.

3. MAJOR FAILURES

Where a product has a major failure under the Australian Consumer Law, you have the rights and remedies provided by that law, which may include choosing a refund or replacement.

You may also be entitled to compensation for reasonably foreseeable loss or damage caused by the failure.

4. MINOR FAILURES

Where a product has a failure that is not major, we may provide an appropriate remedy within a reasonable time in accordance with the Australian Consumer Law.

If the failure is not remedied within a reasonable time, additional statutory rights may apply.

5. CHANGE OF MIND

Unless otherwise stated, Bean & Barrel does not offer refunds or exchanges solely because you change your mind about a product.

This change-of-mind policy does not affect your rights under the Australian Consumer Law.

Where we choose to accept a change-of-mind return as a gesture of goodwill, we may require the product to be unopened, unused, undamaged and in its original saleable packaging.

For food and beverage products, including roasted coffee beans and alcohol, we generally cannot accept change-of-mind returns once the product has been opened.

6. ROASTED COFFEE BEANS

Roasted coffee beans are a fresh food product and may naturally vary between origins, harvests and roast batches.

Reasonable variations in colour, appearance, aroma and flavour do not, by themselves, mean that coffee is defective.

Tasting notes are intended as a guide to the flavours and aromas that may be experienced and are not a guarantee that every person will perceive the same characteristics.

The flavour of coffee can be affected significantly by factors outside our control after purchase, including:

  • grind size;

  • brewing method;

  • coffee dose;

  • water quality and temperature;

  • extraction time;

  • brewing equipment;

  • storage conditions; and

  • the period between roasting, opening and consumption.

This does not affect your rights where coffee is unsafe, spoiled, materially different from its description or otherwise fails to satisfy an applicable consumer guarantee.

7. NATURAL VARIATION IN WHISKY AND SPIRITS

Whisky and other spirits can naturally vary between batches.

Some Bean & Barrel spirits are minimally filtered to preserve flavour, aroma, character and mouthfeel.

Natural oils and compounds may therefore cause cloudiness, haze, flocculation or sediment, particularly at lower temperatures or when the spirit is chilled.

These natural characteristics do not, by themselves, indicate that a product is unsafe, spoiled or defective.

Nothing in this section limits your rights where a product genuinely fails to satisfy an applicable consumer guarantee.

8. TASTE AND PERSONAL PREFERENCE

Individual preferences regarding flavour, aroma, sweetness, acidity, bitterness, body, mouthfeel and other tasting characteristics vary.

A coffee, spirit or other product not matching an individual's personal taste preference does not, by itself, establish that the product is faulty.

This does not affect your rights where a product does not match its description, is unsafe, is not of acceptable quality or otherwise fails to satisfy an applicable consumer guarantee.

9. DELIVERY DAMAGE

If a bottle, coffee product or other product is damaged during delivery, please retain the product and packaging where reasonably possible and contact us promptly.

Photographs of the product, packaging and shipping label may assist us in resolving the issue.

Your statutory rights are not conditional upon providing photographs where imposing such a requirement would be inconsistent with applicable law.

10. REFUSED ALCOHOL DELIVERIES

Where an alcohol delivery is lawfully refused because the purchaser or recipient:

  • is under 18;

  • cannot provide required proof of age or identity;

  • is intoxicated;

  • is not an authorised recipient where authorisation is required; or

  • has otherwise failed to satisfy a lawful delivery requirement,

we may deduct or recover reasonable costs actually incurred in returning or redelivering the order, to the extent permitted by law.

This does not limit your rights where a failed delivery results from an error by Bean & Barrel or our delivery provider.

11. REFUNDS

Approved refunds will generally be returned using the original payment method where reasonably practicable.

Processing times following the issue of a refund may vary depending on your bank or payment provider.

12. RETURNS

Where a product needs to be returned, we will provide appropriate return instructions.

Responsibility for reasonable return costs will be determined in accordance with applicable law and the circumstances of the return.

Please do not dispose of a product you believe is faulty or damaged until we have had a reasonable opportunity to assess the issue, unless retaining the product would be unsafe or unreasonable.
