1. ABOUT US

Bean & Barrel is a trading name operated by The Moment Collective Pty Ltd (ABN 67 696 292 369) (“The Moment Collective”, “Bean & Barrel”, “we”, “us” or “our”).

The Moment Collective Pty Ltd holds NSW Producer/Wholesaler Liquor Licence LIQW880016009, under which eligible alcoholic products offered for sale through Bean & Barrel are sold and supplied.

Bean & Barrel sells alcoholic and non-alcoholic products, including spirits, roasted coffee beans, coffee products, merchandise and related products and accessories.

These Terms of Service (“Terms”) apply to your access to and use of www.beanandbarrel.com.au (“Website”) and to purchases made from us.

Our online store is powered by Shopify. Shopify provides the ecommerce platform used to operate our Website, but your contract for the purchase of Bean & Barrel products is with The Moment Collective Pty Ltd, not Shopify.

By accessing our Website, creating an account or placing an order, you agree to these Terms together with our Privacy Policy, Refund & Returns Policy and Shipping & Delivery Policy.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

2. ALCOHOL SALES AND LIQUOR LICENCE

The sale and supply of alcohol by Bean & Barrel is subject to applicable liquor laws, including the Liquor Act 2007 (NSW), applicable regulations, our liquor licence and any conditions applying to that licence.

We will only sell and supply liquor where we are legally authorised to do so.

We may refuse, restrict, withhold or cancel an order containing alcohol where we reasonably believe completing the sale or supply would:

  • breach applicable liquor laws or our licence conditions;

  • result in alcohol being supplied to a person under 18 years of age;

  • result in alcohol being supplied to an intoxicated person;

  • involve false or misleading age or identity information;

  • involve unlawful supply or resale;

  • involve suspected fraud or unauthorised payment activity; or

  • otherwise expose us, our employees, contractors or delivery providers to a breach of applicable law.

Nothing in these Terms requires us to complete a sale or delivery where doing so would be unlawful.

3. AGE RESTRICTIONS

You must be 18 years of age or older to purchase alcohol from Bean & Barrel.

This age restriction does not apply to roasted coffee beans, coffee products or other non-alcoholic products unless otherwise specified.

By ordering alcohol from us, you represent and warrant that:

  • you are at least 18 years of age;

  • information you provide regarding your identity and age is true and accurate;

  • you are legally entitled to purchase alcohol;

  • you are not purchasing alcohol on behalf of a person under 18; and

  • you will not unlawfully supply alcohol purchased from us to a minor.

We or our delivery providers may require proof of age or identity before supplying or delivering alcohol.

Failure to satisfy applicable age or identity requirements may result in an alcohol order being refused, cancelled, withheld or returned.

4. OUR PRODUCTS

We take reasonable care to ensure product descriptions, photographs, specifications, alcohol content, tasting notes, coffee information, pricing and other information displayed on our Website are accurate.

However, reasonable variations may occur in product appearance, colour, packaging, labels and presentation.

Products are subject to availability. We may discontinue products or reasonably limit quantities available for purchase.

Nothing in this section limits your rights under the Australian Consumer Law.

5. ROASTED COFFEE AND COFFEE PRODUCTS

Our roasted coffee beans are a fresh food product and may naturally vary between batches due to factors including the origin and seasonality of the beans, processing method, roast profile and storage.

Reasonable variations in colour, appearance, aroma and flavour are normal characteristics of roasted coffee and do not, by themselves, indicate that a product is defective.

Coffee tasting notes are provided as a guide to the flavour and aroma characteristics that may be experienced. Individual taste, brewing equipment, water, grind size, dose, extraction and preparation method can affect the flavour experienced by the customer.

For best results, roasted coffee beans should be stored appropriately in a cool, dry place away from direct sunlight, heat, moisture and strong odours.

Any specific storage, preparation or best-before information provided on the product packaging should be followed.

Nothing in this section limits your rights under the Australian Consumer Law.

6. NATURAL CHARACTERISTICS OF WHISKY AND SPIRITS

Some Bean & Barrel spirits are minimally filtered to preserve flavour, aroma, character and mouthfeel.

As a result, naturally occurring oils, fatty acids and other compounds may remain in the spirit. These can occasionally produce haze, cloudiness, flocculation or sediment, particularly when the product is exposed to lower temperatures, chilled or served with ice.

These characteristics can occur naturally and, by themselves, do not indicate that a product is unsafe, spoiled or defective.

Nothing in this section limits your rights under the Australian Consumer Law where a product genuinely fails to satisfy an applicable consumer guarantee.

7. ORDERS

When you place an order, you make an offer to purchase the products included in that order.

We may accept or decline that offer subject to these Terms and applicable law.

We may reasonably refuse or cancel an order where:

  • a product is unavailable;

  • an obvious pricing or product information error has occurred;

  • payment cannot be authorised;

  • we reasonably suspect fraud or unauthorised payment activity;

  • applicable age or identity requirements for alcohol have not been satisfied;

  • we reasonably suspect alcohol is being purchased for or on behalf of a minor;

  • the proposed sale or delivery would breach applicable law or our liquor licence conditions; or

  • we are otherwise legally required to refuse the transaction.

Where we cancel an order after receiving payment and you are entitled to a refund, we will refund the applicable amount using the original payment method where reasonably practicable.

Please check your order carefully before submitting it. Once an order has entered processing or been dispatched, we may not be able to change or cancel it.

8. PRICING AND PAYMENT

All prices displayed on our Website are in Australian dollars (AUD) and include GST where applicable unless otherwise stated.

Delivery charges and other applicable fees will be displayed at or before checkout.

Prices, promotions, discounts and availability may change from time to time.

If an obvious pricing, system or typographical error occurs, we may correct it. Where an affected order has already been placed, we will deal with the order consistently with applicable law.

You must provide complete and accurate billing, payment and contact information.

9. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may be subject to additional conditions, including expiry dates, minimum purchase requirements, eligible products and limits on use.

Unless otherwise stated, discount codes cannot be combined.

We may withdraw, suspend or modify a promotion where reasonably necessary because of an error, misuse, fraud or legal or regulatory requirement.

Promotions involving alcohol will be conducted consistently with applicable liquor laws and responsible service principles.

10. SHIPPING AND DELIVERY

Delivery is governed by our Shipping & Delivery Policy.

Delivery dates and times are estimates unless expressly agreed otherwise.

Different requirements may apply to deliveries containing alcohol and deliveries containing only coffee or other non-alcoholic products.

Alcohol will only be delivered where doing so is lawful.

11. RETURNS AND REFUNDS

Returns, refunds, replacements and other remedies are governed by our Refund & Returns Policy and the Australian Consumer Law.

Our policies operate in addition to, and do not replace, your statutory rights.

12. AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other right that cannot lawfully be excluded.

Where a product fails to satisfy an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or another remedy depending on the circumstances and applicable law.

13. ACCOUNTS

If you create an account, you are responsible for maintaining the security of your login credentials and activity occurring through your account.

You must provide accurate and current information.

Please contact us promptly if you believe your account has been accessed without authorisation.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, content appearing on our Website, including Bean & Barrel branding, logos, product names, photographs, graphics, artwork, copy, designs, recipes, videos and other materials, is owned by or licensed to The Moment Collective Pty Ltd.

You may use our Website for personal, non-commercial purposes.

Except where permitted by law, you must not reproduce, modify, distribute, republish, commercially exploit or otherwise use our intellectual property without our prior written consent.

15. REVIEWS AND USER CONTENT

If you submit reviews, photographs, comments, suggestions or other content to us, you confirm that you have the right to provide that content.

You grant us a non-exclusive, worldwide, royalty-free licence to reproduce, publish, display and use that content in connection with Bean & Barrel, including our Website, social media and marketing.

You must not submit material that is unlawful, defamatory, misleading, offensive or infringes another person's rights.

We may moderate or remove content where reasonably appropriate.

16. PROHIBITED USE

You must not use our Website:

  • for an unlawful purpose;

  • to purchase alcohol if you are under 18;

  • to unlawfully purchase alcohol for or on behalf of another person;

  • fraudulently;

  • to provide false or misleading information;

  • to interfere with Website security or operation;

  • to introduce viruses or malicious software;

  • to unlawfully collect information about other users;

  • to infringe intellectual property or privacy rights; or

  • in any way that breaches these Terms or applicable law.

17. THIRD-PARTY SERVICES

We use third-party providers to operate our business, including ecommerce, payment, delivery, analytics and technology providers.

Those providers may operate under their own terms and privacy policies.

We are not responsible for independent third-party services to the extent permitted by law, but nothing in this section limits rights you may have against us that cannot lawfully be excluded.

18. WEBSITE AVAILABILITY AND ERRORS

We take reasonable steps to maintain the accuracy and availability of our Website but do not guarantee uninterrupted or error-free operation.

We may correct typographical errors, inaccuracies or omissions and update Website information where reasonably necessary.

19. EVENTS OUTSIDE OUR REASONABLE CONTROL

To the extent permitted by law, we are not responsible for delays or failure to perform an obligation caused by circumstances outside our reasonable control, including severe weather, natural disasters, fire, flood, transport disruption, industrial action, government action, telecommunications outages or significant supply-chain disruption.

Nothing in this section excludes statutory rights that cannot lawfully be excluded.

20. LIABILITY

Nothing in these Terms excludes, restricts or modifies any liability, guarantee, right or remedy that cannot lawfully be excluded or limited.

To the maximum extent permitted by law, we exclude liability for indirect or consequential loss arising from your use of our Website or products where that liability may lawfully be excluded.

Where our liability may lawfully be limited, it will be limited only to the extent permitted by applicable law.

21. PRIVACY

Personal information collected through our Website is handled in accordance with our Privacy Policy.

Information may also be processed by Shopify, payment providers, delivery providers and other service providers necessary to operate our business and fulfil orders.

22. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed or read down to the minimum extent necessary without affecting the remaining provisions.

23. NO WAIVER

A failure or delay by us in exercising a right under these Terms does not constitute a waiver of that right.

24. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, Website, products or legal obligations.

The current version will be published on our Website together with its last updated date.

25. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.

You and The Moment Collective Pty Ltd submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from those courts.
